Child Carer Terms and Conditions

Introduction

1.    In this Agreement, Pluxee UK LTD is referred to as "Pluxee".

2.    Pluxee is authorised to contract with various clients in order to issue childcare vouchers to their employees who are working parents and eligible to participate in the HMRC childcare voucher scheme.

3.    By registering as a Child Carer with Pluxee, you agree to accept such vouchers in exchange for the provision of childcare services, subject to redemption by Pluxee.

4.    These Terms and Conditions set out the entire agreement between Pluxee and yourself, the Child Carer to the exclusion of all other terms and conditions, and will be referred to collectively as the Agreement. No additions to or variations of this Agreement shall have effect unless expressly agreed in writing by Pluxee. Only Pluxee and the Child Carer (neither the employee recipient of the voucher nor Pluxee’s clients) may enforce this Agreement.

5.    This Agreement will come into force on the date agreed when you registered as a Child Carer online.

6.    Neither party will be liable for any breach of these terms and conditions, caused by circumstances beyond their reasonable control.

7.    No vouchers will be processed by Pluxee and no payment will be made to you until a copy of the carer’s regulatory body certificate has been provided to Pluxee.

8.    The Child Carer will indemnify Pluxee from and against all claims, costs, expenses, liabilities, damages or losses incurred or suffered by Pluxee arising directly or indirectly as a result of or in connection with any act or omission of the Child Carer or its employees, agents or subcontractors in connection with the provision of childcare services or performance of this Agreement.

9.    Either party may terminate this Agreement immediately if the other party becomes insolvent or commits a material breach of this Agreement, unless said breach is capable of remedy and but is not remedied within thirty (30) days of written notice requiring such remedy. Otherwise, either party wishing to terminate this Agreement may at any time give to the other no less than sixty (60) days written notice.

10.  Pluxee will redeem the vouchers received by the Child Carer subject to compliance by the Child Carer with this Agreement.

11.  This Agreement shall be governed and construed in accordance with English law and the English courts shall have exclusive jurisdiction to determine any disputes which may arise out of, under or in connection with this Agreement.

The Childcare Voucher Programme

1.    Pluxee provides e-vouchers.

2.    Childcare vouchers may only be redeemed by the Child Carer in exchange for childcare services. Vouchers cannot be exchanged for cash or change given, and any attempt to do so will constitute tax evasion. All vouchers must be redeemed by the person to whom the e-voucher was credited. The value of a voucher is expressed on the e-voucher remittance sent to an employee and on the voucher appearing in the employee's account.

3.    The Child Carer shall not charge the employee presenting the voucher a handling fee for accepting the voucher.

4.    It takes four (4) working days to process a voucher payment to a Child Carer subject to sufficient funds being available.

5.    All instructions to process vouchers received will be entered onto the Child Carer's account on the day of receipt or if this is not possible, on the next working day. Pluxee will then instruct the bank to send payment via BACS to the Child Carer on the next working day. Pluxee shall not be liable for any failure or delay to remit payment by BACS (which usually takes 3 working days).

6.    If Pluxee informs the Child Carer that certain vouchers are stolen, fraudulent or otherwise invalid, the Child Carer should not accept such vouchers and Pluxee will not be liable to the Child Carer for non-redemption of such vouchers.

E-vouchers

1.    E-vouchers will be redeemed by the employee accessing his/her internet account and arranging payment directly to your bank account. Pluxee shall have no liability to the Child Carer for sums owed by the employee for the provision of childcare services paid for in this way.

Initial complaints will be handled within three (3) business days of receipt.

If the complaint is not resolved within this timeframe, it will be escalated to the team leader, who will in turn escalate to the Compliance Manger if they are unable to resolve it.

Upon resolving a Childcare Voucher (CCV) complaint, a final resolution letter/e-mail will be sent to the complainant, explaining how the complaint has been resolved.

If a CCV complaint is not upheld or a complainant challenges the final response from Pluxee, the complainant may escalate their complaint to the Childcare Voucher Providers Association (CVPA), as provided below.

Pluxee is a member of the CVPA. In offering the CCV Services, we undertake to act in accordance with the CVPA Code of Practice which is available on the CVPA website at www.cvpa.org.uk. 1.    In providing these services Pluxee acts as independent Data Controller and adheres to current applicable data protection legislation, including the General Data Protection Regulation ((EU) 2016/679) (GDPR), the UK Data Protection Act 2018 as well as any other applicable legislation relating to data protection and privacy.
